Potential Repeal of Section 14(b) of the Taft-Hartley Act

A longstanding target of labor unions has been Section 14(b) of the Tart-Hartley Act (a 1947 amendment to the National Labor Relations Act), which is the so-called Right to Work laws and bars workers from being forced to join labor unions.  Specifically, in the 22 states that have enacted this law, when a union contract is signed, employees decide whether they want to join the union and pay dues; those that do not pay dues work under the same conditions as those that pay dues.  Understandably, Right to Work states have significantly lower unionization rates than do other states.


Although liberal members of Congress have oftentimes attempted to repeal Section 14(b) over the past several decades, perhaps the stars have finally aligned (or the perfect storm is brewing – depending on which side of the issue you fall) and a repeal of the law may be formalized during the Obama era.

A simple comparison of uneployment rates, economic value of production, and employee turnover rate between right to work and non right to work states will easily justify the need for a national right to work law. Individual rights to work without a union is as important as any other individual right. No one questions the worker’s right to a fair wage, or the right to be considered for a job regardless of race or creed, or the right of nondiscrimination. Unions are the only beneficiary of repeal of the Taft Hartley Act or Section 14b of that act.
